Q: I was just granted a judgment in court against one of my customers. How do I collect the money I am owed?
ANSWER: One of the most effective ways to collect on a judgment is to file for garnishment. Garnishment is a document filed in court to get monies held by a third party to satisfy a judgment. There are two types of garnishments: non-wage garnishments and wage garnishments.
A non-wage garnishment is usually filed to collect money from a debtor’s bank account. If the funds in the account are not exempt, a creditor can take the money in excess of $400 from the debtor’s account to satisfy the judgment.
A wage garnishment is filed to require an employer to deduct a certain percentage (up to 25%) of the money from the debtor’s income in order to pay a creditor.
