This is the final installment in the series of articles that have been appearing in the newsletters. This series of articles contains tips and ways to cope with difficult people in your association. This final method is to suggest mediation to settle a dispute that may arise.
Mediation involves the cooperation of all parties involved. The parties present their case to a neutral third party who then tries to help develop a solution. Mediation can be a less expensive route than litigation, often with favorable results.
The parties must actively participate for the process to be a success; however, if an agreement can be reached, it is because the parties invested in the solution obtained.
Mediation is a good way to deal with Association disputes because the individuals involved are neighbors, and if you can work the dispute out, then the parties involved are more likely to retain relationships. The solution has been obtained through a collaborative effort instead of a “winner” or “loser” being dictated by the Court.
